These terms apply to (a) consultants and professionals enquiring about placement and marketing services; (b) hiring companies submitting briefs through the Site; and (c) any other visitor of the Site.
The Site itself is informational. A binding service relationship is created only when (a) we and you agree on scope, fees and timelines in writing, and (b) any required engagement letter, MSA or SOW is signed. Until that point, no obligation is created by your enquiry or our reply.
Placement services are free for consultants. Hiring fees are charged to companies and depend on the engagement model — terms are detailed in the engagement document signed before any work begins.
All content on the Site — text, design, logos, graphics, code — is the property of Yellow Lotus or its licensors and is protected by copyright and trademark law. You may not copy, redistribute or create derivative works without written permission.
The Site may link to third-party services (WhatsApp, Telegram, LinkedIn, scheduling tools, etc.). Those services are governed by their own terms and privacy policies; we are not responsible for them.
The Services are provided on a "best-efforts" basis. We do not guarantee a specific job, salary, interview, hire, time-to-offer or business outcome. Past results do not guarantee future results. Statistics on this Site (e.g. average time-to-offer, placements counts) are historic averages and not commitments.
The Site is provided "as is" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, Yellow Lotus and its affiliates, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the Site or the Services. Our aggregate liability for any claim shall not exceed the fees paid to us by you in the six months preceding the claim, or USD 100, whichever is greater.
You agree to indemnify and hold Yellow Lotus harmless against any claim, liability or expense arising from (a) information you provided that proved false, misleading or unauthorised; (b) your breach of these terms; or (c) your violation of any third-party right.
We may suspend or terminate your access to the Site or the Services at any time, with or without cause, including if we suspect fraudulent, abusive or illegal activity.
These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina, unless otherwise required by mandatory local law.
We may update these terms from time to time. The latest version will be posted here with a new "Last updated" date. Continued use after the update means you accept the new terms.
